Our general sales conditions

1 – Following conditions are brought to the attention of the purchaser and are the law which prevails among the parties. Any order becomes valid only after being accepted and confirmed by a written acknowledgment of our company.
2 – The delivery times, the availability and collection periods which are indicated by the seller are only given as an information but may vary; even if they are longer, not any order cancellation or compensation may be demanded. The times indicated on our acknowledgements of orders are given as an information and are ex-works if not stipulated in a different way. Should an order, for any reason, not be executed in the agreed time and without a formal notice, we reserve ourselves the right to deliver the goods, the buyer being obliged to accept them.
3 – Our goods travel at the own risks of the buyer. In case of damage during the transport, the addressee has to lodge an appeal against the carrier. The complaints must be made during the delivery of the products.
4 – The prices indicated on our price lists or price offers are drawn up according to the economical conditions existing at the moment the document is sent. They may be revised at any time according to the changes of the economical conditions. Unless explicitly in writing otherwise stipulated, the prices indicated in a price offer do only commit the seller in the strict limit of this price offer and cannot implicitly be extended to a further or complementary order, even if executed during the validity period of the offer. Any price bound up with a quantity is of course only valid for an order with this whole quantity. Unless otherwise stipulated, the prices are given in Euro, VAT excluded. They are carriage paid and packaging included for Metropolitan France if the net amount of the delivery is more than 230 € excluding VAT (except express). For any order with a net amount less than 230 € excluding VAT, the prices of the general price list are applied without any discount and with an extra cost of 20 € for the order processing and the transport in Metropolitan France. The minimal invoicing amount is 80 € VAT excluded. Every packing unit (standard or box) constitutes an indivisible unit.
5- Our products are guaranteed for a period of one year against any design fault or material defect. The complaints concerning the quality of the goods, with the exception of any transport litigation, must immediately be made during the delivery if it is a visible defect or within 15 days after the delivery if it is a non visible defect. No goods should be sent back without a prior agreement of our company, to which any complaint should be sent. Our responsibility is limited to the pure and simple replacement of the goods which is admitted as being defective or to the reimbursement at the price of the invoice.
6- The payment of our invoices is due 30 days from the date of issue of the invoice, unless otherwise stipulated. The payment place is POMPADOUR. The acceptance of drafts does not infringe this clause.
From the 1st January 2013, any default by the Customer, in whole or in part, of its obligations to pay or any delay in payment may allow us to ask, without prejudice to any damages, for the payment of recovery costs of 40 euros fixed by decree under section 121 of the Act of 22 March 2012 related to the simplification of the law and of the administrative procedures.
Pursuant to the article 33 of the ruling 1243 dated 01.12.1986, we reserve the right to apply a penalty equal to three times the legal interest rate currently in effect for any sum still remaining unpaid at the due time. This penalty will not require any prior notice. Otherwise, the non payment of any sum due will automatically lead to the payability of the whole sum remaining due and to the suspension of the deliveries. In case the payment is brought forward, a 0.6% discount per period of 30 days will be granted.
7- The material to be repaired shall be sent back carriage paid to the address of our head office. The material will be examined on receipt and an estimation for repairs will be sent to the buyer. The material will be repaired only after written approval of the buyer.
8- Decree n° 2014-928 of 19 August 2014 relating to the waste of the electric and electronic equipment and to the waste disposal resulting from these equipments, requires producers of electrical and electronic equipment to take in charge the removal and the treatment of their end of life products in the market after 13 August 2005. Consequently Mecatraction offers you to contact our company to organize the removal of your WEEE.
9- The goods are sold subject to ownership. The ownership will only be transferred to the buyer after complete payment of the price of the goods and accessories. In particular, the seller will be able to prevail over all the measures of the law 80335 dated 12th May 1980.
In case of any contestation, the court dealing with trade disputes of our head office is the only one to be competent.
These sales conditions are provided in French and English. In the event of a discrepancy, the French version prevails.
